The initial letter included the sequence of events, a finding of violations, assessed damages to the property, and outlined minimum mitigation requirements. In addition, an Investigation Report for Unauthorized Land Clearing was provided to the property owner as part of the Zoning Violation Letter.

During the first week of January, the Town’s Development Services Director spoke with a representative of the property owner to review the findings and discuss next steps.

The Town issued a follow-up letter, including a Code Enforcement Notice of Mitigation Requirements, to the property owner on Wednesday, January 14, 2026. The mitigation outline includes:

  • A schedule for cleanup and removal of all debris from the activities located within the floodplain and buffers; and
  • The submittal of a replanting plan using native plants, including an implementation schedule. This plan must be reviewed and approved by the Town’s Development Services Director before replanting begins.
  • Additional mitigation measures were noted dependent upon completion of measures one and two.

The Town reminds the public that no debris or materials, including storage, may be placed within floodplains or buffer areas, as such materials can be flushed back into streams and culverts.

The Development Services Department will continue to monitor the site and provide regular bi-weekly communication until the mitigation requirements are met, and the violation case is closed. The Town remains committed to enforcing all applicable regulations to protect public safety, waterways, and natural resources.

Additional updates and information will be released as they become available.
